This is horrible. I don’t understand at all. It seemed to me like things were going their direction.

It is likely the practical thing to do. Because things have been going well, they have probably worked out a plea that involves minimal jail time. Something like 98% of defendants are found guilty at trial in the SDNY.
I'm not saying the system is rigged. Actually, I am saying the system is rigged.

Man, this is just horrible. I hate the idea of them going to jail for basically enforcing the fourth amendment onchain in America, but I’m also trying to remember if plea deals establish case law. You’d be the guy to ask, right?

reply

In order to accept a plea, the defendants will have to admit to facts that constitute the crime they are pleading guilty to. It is called an allocution. Whatever conduct is admitted to, if the court agrees it is sufficient to establish the crime being pled to , could serve as precedent. However, if there is no appellate review (if the defendants waive the right to appeal), its precedential value is low.

reply

yeah but that "guilty stink" will last for a long while. it's the SDNY that should plead guilty for limiting freedoms of people (for their own protection).... imho...

reply

Damn right on both counts.
