The likelihood of the 49ers being the 5th seed is very slim. Although they hold it now if they win today they will be the 1 seed if they lose they will be the 6th seed. It is possible to finish 5th but would require the Rams losing to the Cardinals on Sunday.

I doubt the league wants to see that outcome. If it's heading that way, expect some egregiously bad officiating pushing back against it.
