legally, the ability to spend another person's money does not make you a custodian. else, anyone storing your credit card info would be a custodian.
legally, at least afaik, custody is defined as you being able to deny me access to my money unilaterally. even when they are run in a secure enclave, that's true of ecash mints.
to put it another way, this is why unilateral exits are such a big deal (beyond it being a nice-to-have).
i don't know how many times we'll witness ecash influencers claim ecash is noncustodial, but this is at least the third time by my count.
