In the scenario you mentioned, the person with the rebuy wins the pool because he earned it
Last year, the winner won with zero re-buys
Why punish survivors for surviving?

edit: you mention week 12, so let's extend it to week 12, week 10 sounds arbitrary, maybe no re-buys after Thanksgiving or no re-buys after Christmas
