He already had a fair trial where he was convicted of violating the computer fraud and abuse act. His actual offense is sealed, but it would have been something like ddos, spreading malware, intentionally destroying someone else's data, etc: https://www.courtlistener.com/docket/16517474/united-states-v-rockenhaus/
He violated the terms of his supervised release, and the government executed an arrest warrant where he got hurt because he was being combative. Tor isn't even mentioned anywhere.

Who knows. We are missing a lot of info but upon skimming the witness hearing linked in the OP this seems correct. He is suspected of violating the terms of his release. That's the official story at least.
