Two things that can be true at the same time
  1. Privacy is not a crime. There is a war on privacy and the proposed fincen rule that attempts to treat mixing as suspicious by default is creating reporting requirements on standard privacy practice which even they themselves acknowledge has legitimate use. This is bad and is government overreach and should be fought. Samourai were doing a good job leading the charge in this fight.
  2. The allegations against Samourai point to very specific things like tweets and investor materials that showed they welcomed and encouraged illicit actors to use their service. If people haven’t read the DOJ materials they should. The PDF not the press release. I heard people in spaces claim the govt doesn’t Understand how the tech works. This is bullshit. Read the PDF where they describe exactly how it works. Whether the centralized coordinator is actually “money transmission” is probably a stretch. However, it doesn’t seem a stretch that based on the evidence collected they were encouraging users of darknet markets to use their service and marketing it as such to investors and the public in tweets. As such running a service that allegedly enabled money laundering, even non custodially, is what the DOJ is going after here.
The war on privacy must be won by making privacy the default. But we must also approach this with maturity. Perhaps by building privacy tech that is decentralized rather than run by a VC funded American company. And not going out of the way to market services to criminals.
Samourai were trying to do the right thing to provide privacy tech for many legitimate people. Criminal use is a small fraction of mixing use. The merchant where you spend your bitcoin shouldn’t know how much bitcoin you own. But they were wrong to go around promoting a service to criminals and the design using a centralized coordinator run by a company was an obvious SPOF and was predictably attacked after they kept poking the bear.
