First come first serve. Anyone, including the previous territory owner, can purchase and restart them with all previous content intact.

Eventually there will be a list of such territories.

can the decision be made to nuke content of the territory upon reclaiming? I wouldn't be a fan of that but just curious

It wouldn't get nuked. The content would just be moved to a sub-territory of ~archived or ~dead or ~foreclosed or ~deserted or some such.
