I've relayed your question on their AMA
I presume the response will be that SideSwap is an atomic swap service. So they don't hold any user funds at all. If the site goes away, the next attempt to do a swap using Instant simply fails as there is no site.
Using the app should still work, I presume, but maybe it has a dependency (e.g., price oracle) that would cause the app to not work.

Our code is open source and your seed can restore your wallet with other wallet providers. Should a hypothetical government claiming global jurisdiction come after us with a different view, well, SideSwap may cease to be a going concern.
