This is a blatant violation of the First Amendment. This is identical to the usage of ITAR to prohibit publishing gun designs online. Chip manufacturers could sue and they are 100% guaranteed to win the case.
If BIS were to not back down from such a lawsuit and allow export of 3nm tech, they would risk the Supreme Court striking down the laws that created the BIS for being unconstitutional.

BIS has banned the export of certain software (in addition to three materials). Publishing software is unambiguously protected by the First Amendment.
