NEW YORK — A new law in New York state will be going into effect soon that will affect contractors and sub-contractors who do construction work on public and some private projects.
The New York State Department of Labor (NYSDOL) says the new law goes into effect December 30, 2024.
Contractors will now have to register before submitting any new bids or begin work on a covered project on or after December 30, 2024. Sub-contractors need to register before starting any new work on a covered project as well.
To register, contractors and subcontractors must apply through the NYDOL's Contractor Registry Portal via NYSDOL’s Management System for Protecting Worker Rights (MPWR). All applications must be submitted online and fees paid by credit card.
If approved, you will receive a Certificate of Registration electronically. Your registration is not approved until you receive your certificate. Once you receive your electronic certificate, you're encouraged to print it out for your records. The process could take several weeks.
If your registration is not approved, you can address the issue, or request a hearing within 30 days of the notification.
Registration is good for two years from the date of issuance. Both contractors and sub-contractors must renew at least 90 days before their current registration expires.
I wonder how many contractors and subs are out there scamming for NYS to put this law into place. I assume this will be a requirement for government type work but more administrative burden that gets in the way of productivity.
