The DoJ would not dare add Cryptome as co-defendant, because Cryptome's lawyers would turn it into a 1st Amendment case, which the DoJ has no chance of winning.

But this story brings up some critical info that I hadn't heard before:

  • That a US General testified under oath that nobody was harmed by the Manning leaks.
  • That the only "harm" to the USG was to somewhat degrade USG foreign affairs.
  • That an American citizen did exactly what Assange did, and yet has never been prosecuted.

I suspect Cryptome knew full well they weren't likely to be prosecuted, but this was a great public relations move to help Assange.
