Yeah, no matter how negligent the organization was in keeping Kay on the payroll, I still don't think they are liable for Skaggs' death. (Just speaking from my perspective, I have no idea what the law actually says).
It sounds like Kay has some deep connection to the organization though, which wasn't made clear in the article. Why do they protect him so much?
So the issue is that the environment created by the organization was very poor and this stuff was common place and accepted. Kay was a known drug user going back to 2013 and had even been sent to rehab by the team. Its unclear if he ever got sober as his office was a known place to do drugs and at one point a team employee was sent to go check on him at his house. The team employee found him from my understanding blitzed and breaking down pills into tiny baggies for ya know.... distribution.
Other employees within the organization had to take drug test (Kay didnt) and if drug instances occurred (especially at team facilities) it was reported and these people were fired. This stuff never happened to Kay but the trail of evidence is damming to say the least. For instance Kay was also caught doing lines in the clubhouse kitchen, Kay gave Skaggs the pills on team travel to Dallas, and Kay was in his room the night he died.
As part of the case the Angel initially wanted to argue that Kay didnt do it. That was there defense just a couple of weeks ago before the Judge told them they could not reargue the facts and conclusions reached in the criminal trial.
