It's just like with exchanges. How can you know if your anon customer is on the OFAC list? You can't. Therefore, you must KYC everyone. Exchanges that respond thinking only doing a geofence based on IP, instead of KYC, will keep them out of the US Gov's sights. Ask Arthur Hayes this Friday what he thinks about doing that?
They are trying to head off an informal economy from participating. Once you are "formal", and income gets reported, then they can tax, and more importantly, control you (i.e., social credit score). But this "advisory" is how it starts. And then comes regulations that state that you cannot hire a freelancer in India, in Kenya, or wherever, without first performing KYC.
Agree. Seems that Jack Dorsey's TBD project is trying to play the middle ground with this kind of thing. Perhaps with such a system, I could prove I'm not on the OFAC list without revealing other parts of my identity. Or prove I'm over 21 or some other such thing.

You have a wrong idea about what a "country" is. My body is my "country". Wherever am I. If I travel, I am just a diplomatic in another country.
But yeah, if you bend the knee and use a gov-ID, you must obey their rules.
I live like that for years. And is just fine, if you know how to deal (enter in contract) with public institutions or private individuals. It's all about a contract. The whole world is based on commercial contract.
The Convention on the Rights and Duties of States is an international treaty signed in Montevideo, Uruguay, on December 26, 1933.
The convention establishes the definition of the State, its rights and obligations.
In Article 1 it establishes four characteristic criteria of a State that have become part of customary international law.
They have been recognized as confirmation in International Law, establishing that a State as a person of International Law must meet the following requirements:
ARTICLE 1
The State as a subject of International Law must meet the following requirements:
I. – Permanent population.
II. —Determined territory.
III. -Government.
IV. —Ability to enter into relations with other States.
Under these guidelines, any entity that meets these criteria can be considered a sovereign state under international law, whether or not it has been recognized by other states.
Independent Republic REML meets and fulfills the 4 requirements of Article 1 of the Montevideo Convention on the definition of the State.
ARTICLE 3
The political existence of the state is independent of its recognition by other states.
Even before being recognized, the State has the right to defend its integrity and independence.
ARTICLE 7
The recognition of the State may be express or tacit. The latter results from any act that implies the intention to recognize the new State.
