The constitutions are still in effect, but if you don't know how to enforce those God-given rights, then the state will walk all over you. In fact, most of the laws are written in line with those constitutions! What many don't understand (even many lawyers) is how to read the laws. There is a bit more than just understanding statutory construction, but my hope is that seeing this will wet your whistle to want to learn more. We will use Kentucky as our example. The first definition shown dismantles 99% of the applicability of the statutes to men & women. Where I have brackets [ ] will be words to pay attention to based on definitions.
KRS 446.010 Definitions for statutes generally
(33) “Person” may extend and be applied to bodies-politic and corporate, societies, communities, the public generally, individuals, partnerships, joint stock companies, and limited liability companies;
construction of statutes - ejusdem generis – all of the words above are artificial entities, men & women are not and therefore, are not included in the definition of ‘person’ unless it is re-defined properly in that subsection

(7) “Operator” means the [person] in actual physical control of a [vehicle];

(a) “Vehicle” includes:

- All [agencies] for the transportation of persons or property over or upon the public highways of the Commonwealth; and

- All vehicles passing over or upon the highways.
(b) “Motor vehicle” includes [all vehicles], as defined in paragraph (a) of this subsection, except

- where one person acts for another, either in the relationship of principal and agent, master and servant, or [employer or proprietor and independent contractor], Gorton v. Doty, 57 Idaho 792, 69 P.2d 136, 139.
- Properly speaking, agency relates to [commercial or business transactions]. Humble Oil & Refining Co. v. Bill, Tex.Civ.App., 172 S.W.2d 800, 803.
Using your automobile to get from Point A to Point B is not a commercial or business transaction. This code only applies to commercial/business entities. Commercial agents are things like taxicab drivers, semi-truck drivers, etc.
Kentucky Constitution, Section 11:
In all criminal prosecutions the accused has the right to be heard by himself and counsel; to demand the nature and cause of the accusation against him; to meet the witness face to face, and to have compulsory process for obtaining witnesses in his favor. He cannot be compelled to give evidence against himself, nor can he be deprived of his life, liberty or property, unless by the judgment of his peers or the law of the land; and in prosecutions by indictment or information, he shall have a speedy public trial and an impartial jury of the vicinage; but the General Assembly may provide by a general law for a change of venue in such prosecutions for both the defendant and the Commonwealth, the change to be made to the most convenient county in which a fair trial can be obtained.
US Constitution, 4th Amendment:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
There MUST be a claim/witness against you BY ANOTHER HUMAN to say that you’ve committed a crime and/or must have PROBABLE CAUSE (otherwise it’s an unreasonable seizure/detainment) and to be able to SEIZE/SEARCH/detain you, there must be a WARRANT SUPPORTED BY OATH OR AFFIRMATION AND SIGNED BY A JUDGE that DESCRIBES the human to be seized/searched.
The officer who writes a ticket to someone that is not operating in commerce is actually, himself, committing a crime by trying to force commercial intercourse with a non-applicable human and a criminal complaint can be filed against him.
Those who don’t enforce their rights, have none.
