These are Guantanamo guys. The rules are different. Typical prosecutions don't involve the defense secretary.
Even in traditional prosecutions, there are ways to unwind plea deals, depending on the facts.

If a deal is seen as lenient, the Republicans can use the deal against her in the election. She is tied to the current administration as vice president. I can see the ads now. Harris locks up people for minor marijuana violations, but gives terrorists a plea bargain.

Yes, that's possible. Remember, Harris was a prosecutor who was very tough on non violent offenders.
