Yes. And you can double-spend that chain against main chain, then sell the doublespend in an atomic swap. Recommend against it though.

Is there any way to make sure which chain I’m using?

The chain you use is the chain you validate. Or, if you're a bank appreciatoorrr, the chain your bank validates. Good luck with that one, haha.
