An amendment has to be ratified by 2/3 of congress.
A hard fork is just a Bitcoin implementation with a consensus change that loosens the rules.

To change the constitution you need to convince millions voters first.
To change the bitcoin rules you need to convince all full nodes operators to install new software, who is not so many.
