The data carrier size has always referred to the limit for op_return outputs. Luke decided unilaterally that it should also apply to inscription envelopes, and made the corresponding change in his own full node software, Knots. Some people want inscriptions to be non-standard and have been advocating for this change to be merged in Bitcoin Core, but it has not gained support among other Bitcoin contributors for various reasons.

Interesting. After ruminating and podcast listening I've come to the conclusion that 'the bug' is in the mind. A similar example might be..
You had a recycling trash bin and a regular trash bin. Someone kept filling the recycling trash bin with regular trash and then phoned the local council to report that the recycling bin has a bug.
